Tina Peters’ appeals delayed until next year

Tina Peters’ appeal of her nine-year prison term for various election-related charges has been delayed until next year.

The court has extended their vacation time indefinitely.

No cases are on the Colorado Appeals’ Court calendar for next year.

Even though 22 judges are assigned cases in sets of three.

Peters’ asked to be released on bond pending appeal of her conviction.

It was denied on December 6th by judges appointed two years ago by Governor Jared Polis (D-CO).

Before the judges heard their first case, none had appeals or criminal law experience.

They had to be told where to find the courthouse.

Judges Gomez, Schutz, and Lum ruled against Peters without:

  • a public oral hearing

  • nor a review of trial court transcripts required by law.

In Colorado, court hearings are not subject to public records.

Neither is the evidence presented in its cases.

On December 3rd, Tina’s appeal to a misdemeanor case was heard before Judges:

  • Stefanie Dunn (left on the judicial bench below)

  • Christina F. Gomez (middle)

  • Daniel Taubman (right)

Rich Tuttle is the Prosecutor.

Tina Peters’s attorney is John Case (right bottom corner).

Having Gomez rule on two cases involving Tina Peters is a conflict of interest.

One judge, Anthony Navarro, noted the conflict and recused himself from the case.

Taubman replaced him.

None of the 20 remaining Appeals Court Judges wanted the assignment.

Coming out of retirement to participate in Tina’s Dec. 3rd appeal were:

  • Judge Daniel Taubman, who retired three years ago

  • Prosecutor Rich Tuttle, who retired last year.

Editor’s notes

It should be noted that the Appeals Court has reversed several criminal cases because prosecutors were caught getting convictions based on fabricated evidence.

And their false convictions were sustained by the Colorado Supreme Court.

One involved the trial judge, Matthew Barrett, in the appeal matter in the above video.

He was the judge who sentenced Tina Peters to nine years in jail.

The Colorado Supreme Court reversed the Appeals Court decision that Barrett erred in admitting tainted evidence in the Peters’ cases.

The Appeals Court said Barrett’s self-proclaimed “common sense” had no place in his courtroom.
